To our Distributor Partners,
As you may know, the new rules for Proposition 65 (Prop 65) have taken effect in California since August 30, 2018. The Prop 65 initiative that became a state law in 1986 known as the Safe Drinking Water and Toxic Enforcement Act, sets out environmental regulations regarding toxic chemical substances that businesses are subject to when they sell merchandise in that State. The Act and its new regulations update warning requirements for consumer products sold to customers in California that contain certain chemicals identified by the State. For further information on Prop 65, please refer to the following link: https://oehha.ca.gov/proposition-65/about-proposition-65
Like many in the industry, we test chemicals of high concern, which would be the ones having court settlements and appearing in 60-day notices. Therefore, we have tested our sunglasses for the most common Prop 65 chemicals specific to sunglasses and the results are negative.
However, there is a recent court case that lists BPA, a chemical that can also be found in polycarbonate. Therefore, we will be putting a Prop 65 warning label on all our sunglasses produced and shipping to the State of California or any fulfillment center. This means you can continue selling our sunglasses in California!
All sunglasses shipped by Bold Promo into the State of California are subject to Proposition 65 (“Prop 65”) or The Safe Drinking Water and Toxic Enforcement Act of 1986.
In accordance with the Prop 65 requirements, we will be putting a Prop 65 warning label on all our sunglasses produced after August 30, 2018 and shipping to the State of California or any fulfillment center.
You will find the image of the warning label below:
